Welcome to Workscale Resources Inc. and its affiliates respects your privacy when using our app, via web at hris.workscale.ph or mobile apps downloaded various app stores platforms. By using Workscale Resources related services and application, you agree that we may use and store your data following Privacy Policy. This Privacy Policy is designed to help you understand how we collect, use, and safeguard your personal information when you use our app. 

2. Information We Collect 

We may collect various types of information from you when you use our app, including but not limited to: 

a. Personal Information: 

Personal Information means the data that can be identified by you personally, which following info:  

• Client Information such as Full Name, SEC Registration Number, TIN, Address, Contact Number, Email Address and Client Logo 
• Client Contract Information such as Start Date and Termination Date, Status, Signee and Cut off period 
• Admin Information such as Full Name, Username, Password, Position, Phone number and Email Address 
• Employee Personal Information such as Full Name, Gender, Marital Status, Date of Birth, Emergency Contact Name, Emergency Contact #, Address and Picture 
• Payroll Information such as TIN, Philhealth, SSS, PAG-IBIG, Loan Information, Compensation Information, Bank Information 
• Family Background such as Spouse Name, Date of Birth, Occupation, and Family details 
• Educational Information such as Educational Attainment, School and it’s Address, and Training History 
• Work History such as Name, Position, Reason for Leaving, Address and Inclusive Date 
• Reference Information such as Name, Contact Number and Address 

 b. Usage Information: 

We collect your Personal Information to identify you when using Workscale Resources related services and application. 

When you use Workscale Resources application as an employee, Personal Information collection happens when filling up application form during first time registration by your representative, based on the information you supplied. 

Location Data Access. When you run myWorkscale as an employee user, you will be asked to access your location approval directly. Granting your location access depends on the device permissions you use and agree to. You will be asked to allow us to access your actual location information through your device when you want to record timesheet or attendance. We will collect your location data for this purpose, including your IP Address and GPS. 

Face camera (or selfie). When you run Workscale Resources application as an employee user, in connection with module attendance or absence management, you will be asked to access a photo of your face. Granting your photo access depends on the device permissions you use and agree to. We will collect real time data photos of your face which are intended to record your attendance data and supervisor may use it for verification. You may choose not to grant access to the photo of your face through your device and can still use the Workscale Resources application, but this may affect the recording of your attendance. 

When you use Workscale Resources application as a company representative, your representative will fill in your company information on the form page provided, based on the information you supplied. Details of filling out the data form can be in the form of, such as company name, company organizational structure, job title, email, employee name and ID card, bank account data, photo, salary nominal, and payroll period date. 

 3. How We Use Your Information 

Personal Information will be used for the provision of services and following various usages:  

a. When using Workscale Resources application as an Employee, we use your information as follows:  

• Identify and utilize Personal Data while using Workscale Resources application; 
• Provide services for timesheet, attendance, leave application and overtime; 
• Perform Location Access check; 
• Take real time face photo from your phone camera 
• Calculate salary according to attendance for payroll and billing 
• Contact via email, telephone, or other communications; 

b. When using Workscale Resources application as representative of your company, we use your information as follows:  

• Administer your company account registration on Workscale Resources application; 
• Provide information on the process and mechanism of payment through bank accounts; 
• Provide access to Workscale Resources application features; 
• Make payments to your employees’ salaries following respected salary period; 
• Perform monitoring, analysis, and development of myWorkscale; 
• Contact via email, telephone, or other communications; 

4. Data Security 

Workscale Resources application always try to provide and have implemented an adequate security system to safeguard your Personal Data, including the placement of data on AWS cloud server. We will maintain the security of your data and prevent unauthorized access, collection, processing, use, disclosure, copying, and modification. However, we recommend that you always pay attention and be careful in providing your Personal Data while using Workscale Resources application. No technology is completely secure in transmission or storage, and you should be careful with the information you transmit. 

Modern web browsers are also used for accessing the service, the robust transport layer security technology is used for protecting the customer data through data encryption and server authentication. The technology is capable enough to keep the data safe and secure.  

Workscale Resources application uses state of the art enhanced software security infrastructure called Cloudflare Zero Trust Tunnel that provides maximum security of data encryption, protection from cloud attacks by hiding server IP address from being accessed directly.  

However, you should also recognize that there is no such thing as “perfect security” on the internet, and not all times we can guarantee the security of your information because internet is basically unsecure and data transmission may be intercepted which is already beyond our control, and we are not liable for any data breach related to it.  

5. Disclosure of Information 

We may need to disclose your information to following recipients: 

• To your employer, members of the finance or Human Resources division for their purpose 
• To affiliates who develop Workscale Resources application
• To the bank for the agreed payment or salary payment 
• To the government in power or authorized institutions, including the police, manpower agencies, courts, or international government agencies, and aimed at implementing legal decisions or prevailing laws and regulations. 

6. Third-Party Services 

To the extent that we receive information in connection with third-party services, we may use this information for the purposes specified in the agreement.  

Workscale Resources application uses AWS and Cloudflare third party software services, and their respective Privacy Policies are also available in public. We encourage you to review their privacy Policies.  

 7. Children’s Privacy 

Workscale Resources application is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe that we have inadvertently collected information from a child under 13, please contact us, and we will take the necessary steps to delete the information.  

8. Changes to this Privacy Policy 

We reserve the right to update this Privacy Policy to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify you of any material changes by posting the updated policy on our website or within the app. Your continued use of Workscale Resources application after any changes signifies your acceptance of the updated policy.
